Legal Brief: Florida Supreme Court Refuses to Clarify Conflicting Appellate Court Rulings on Whether Additional Damage Estimates Are Required for Supplemental Claims

Earlier this month, the Florida Supreme Court declined to consider a petition filed by American Coastal Insurance Company seeking clarification of conflicting appellate court decisions surrounding whether or not an additional damage estimate is required when filing a supplemental claim. So for now, the law continues to be interpreted differently in different Florida appellate districts. This will inevitably complicate claims handling practices for insurers and will also make negotiations of settlements difficult for them.
